Today a federal appeals court struck down California’s ban on same-sex marriage, ensuring the issue will ultimately be decided by the Supreme Court. At the heart of the matter is whether or not marriage is a fundamental right that cannot be legislated away, or is simply a priviledge or a legal right that can be decided by a majority of California’s citizens.
